But so far as the costs of the hearing before me is concerned the plaintiff will have to pay two-thirds of the costs of the actual hearing before me And as far the cost of the commission for examination of Sm. [...] This cause coming on this day for final disposal pursuant to the decree made herein and dated the 15th day of July 1949 before the Hon'ble S. R. Das Gupta one of the Judges of this Court in the presence of the advocates for the plaintiff and the defendant Ratanlal Chamria (the other defendant Keshardeo Chamria not appearing either in person or by advocate). [...] It is ordered and decreed that the said report of the Special Referee appointed in this suit and dated the 28th day of April last and filed on the 5th day of June last as varied by the order made herein on the 5th day of December last on the application of the plaintiff and the same is hereby confirmed And it is further ordered and decreed that the defendant Ratanlal Chamria to pay to the plaintif [...] 1948 in this suit and in view of the fact that the said Ratanlal's claim for set-off has been rejected the Learned judge erred in the circumstances in not allowing interim interest and the entire costs of the suit to the PlaintifAppellant. [...] For that the Learned Judge erred in dealing in piece-meal with the question of costs on different issues and sub-issues and in directing the appellant to pay a portion of the costs of hearing before him to the RespondenRatanlal.
