[...] The difficulties so clearly pointed out by the learned Munsif of the difference between the tenure of the family ancestral propeirty with the right of survivorship and the interest in Jogi Reddi's property with no right of survivorship make the alleged gift the less likely. [...] The presumption is stronger in the case of brothers than in the case of cousins and the further one goes from the founder of the family the presumption becomes weaker and weaker.
