The Respectful Memorial of the State of Morvi in KATHIAWAR Sheweth I have the honour to submit this representation in reference to the depatch of Your Lordship's predecessor and in reference to the orders of the Governme ht of Bombay issued in consequence of that despatch in regard to certain pecuniary claims of my younger brother Kumar Harbhamji against the Morvi. [...] That the Political Agent was the trustee of the Morvi State in 1873 and had no power to confirm any grants believed to be fraudulent against the interests of a minor of whom he was a guardian ; X. That the construction which in the said despatch is placed upon the order of 1873 is irreeoneileable with the last passage of the order self and is opposed to the construction which theretofore had been [...] The view that the Political Agent's order of 1873 was an Act of State exempt from the cognizance of a Court of justice involves the assumption that the Poltical Agent can at any time grant away the money or the village of a State of which he is a trustee without any grant from the last chief and even without any authority from the Secretary of State But the assumption of such a power. [...] would I repectfully submit be a clear infraction of the guarantee given to my State by the British Government in 1807-8 would be subversive of the rights of the States confirmed by the solemn pledges and assurances of the Paramount Power and would be inconsistent with the principles which regulate the relations of the British Government with the States of this province. [...] The fact noted in clause 3 of para 3 of the Despatch: — That when Harbhamji complained to the Political Agent in 1886 of the resumption of the funds by me that officer instead of requiring the Thakore Saheb to respect the order of 1873 until it should be reversed by Government and dealing himself with the case by referring if necessary to Government referred Harbhamji for relief to the inferior C
