Section 297 imposea a duty on the trial Judge to lay down the law for the guidance of the jury; in other words to explain the law applicable to the facts and circumstances of a particular cash ill clear and unambguous terms so that the jury contesting of laymen may be able to understand and apply the same.to the facts Criminal P. C.—oontd. [...] Where the law appPcable to the facts cf the case was not properly placed teloie the jury and there was midirection to the jury in that the Judge had expressed his opinion cn the facts in issue witho giving the necessary earning to the ju r or e jury could not be described a it w and the accused was preju ced and the tr ated. [...] It is not necessary for the Court to put every detail of the evidence before the accused but the broad facts of the use against the accused should be put to him by the Court and the Court should ask the accused whether he would like to explain the circumstances wield appear against him: & written statement of the accused cannot take the place of statements required to be made under the provisio [...] Where the Sub-divisional Magistrate occupying a position superior to that of the trying Magistrate had sent a letter to the latter to adjourn the case pending before him and also wrote the terms of the order to be passed: Held that the action of the Sub-divisional Magistrate ImousPled to clear interference with the judicial discrtion of the trying Magistrate and he was guilty of the contempt [...] Inilbereull that the appellate Court has are the beads of charge delivered to the jury before they retired in the first place the appellate Court has only part of the charge before it and cannot come to any conclusion about validity or otherwise of the verdict of the jury and maintain the coriviotion.
