The complainant moved the Allahabad High Court for contempt under section 3 of the Contempt of Courts Act and the second appellant was held guilty of cotempt of the court of the Sub-Divisional Magistrate. [...] Mahajan J. in delivering the judment of the Supreme Court quoted ecerpts from the judgment of the Allahabad High Court which contained the reason for the view the Allahabad Judges tool They were quoted only to meet with diapproval. [...] So far as the first appellant was cocerned the Supreme Court held that under the 'provisions of section 528 of the Code of Criminal Procedure the District Magitrate had authority to withdraw the case. [...] Mahajan J. held : "We have not been able to see how such an action on the part of the District Magistrate done in the normal and usual course 'of the discharge of his drities as such magistrate could be held to interfere with the due course of administration of justice or to create prjudice of any kind against the complainant in the proceedings under section 145 of the Code of Criminal Proc [...] of a formulation' of the principles of international law reconized in the Charter and judgment of the Nuremberg trials of war criminals.
