The burden of establishing guilt of the accused is throughout on the prosecution and the prosecution must prove every link in the chain of evidence against the accused from the beginning to the end. [...] (11) The learned Sessions Judge has relied' upon the confession of the accused which was subsequently retracted by him before the com- mitting Magistrate and before the Sessions Judge and also on the fact that the accused was last seen with the deceased on the fateful day of occurrence.
